Terms of Service
These Terms of Service ("Terms") govern your use of the Oriia mobile application ("the App") and the website at oriia.app ("the Site"), together "the Service". By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Oriia is operated by Fiorella Fonseca, an individual sole proprietor based in Italy ("we", "us", "our").
1. Who can use Oriia
You must be at least 14 years old to use the Service. Under Italian law (Article 2-quinquies of the Codice in materia di protezione dei dati personali), 14 is the minimum age for valid consent to information society services. If you are between 14 and 18, you confirm that a parent or legal guardian has reviewed these Terms with you.
You agree to provide accurate information (including birth date, birth time, and birth location) so that the Service can compute your birth chart correctly. We are not responsible for incorrect output if you provide inaccurate inputs.
2. Your account
Oriia creates an anonymous account for you on first launch. You may link the account to Apple Sign In or Google Sign In; the linked email is used solely for account recovery and notifications you opt into.
You are responsible for the activity on your account. Keep your sign-in credentials confidential. If you suspect unauthorized access, contact us at [email protected].
3. Subscriptions and pricing
Oriia offers a Premium subscription ("Oriia Premium") at:
- $9.99 USD per month (auto-renewing monthly)
- $49.99 USD per year (auto-renewing annually)
Prices may vary by region as set by Apple's App Store pricing tiers. The amount actually charged is displayed in the App's paywall in your local currency before you confirm the purchase.
Auto-renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. The renewal charge is billed to your Apple ID.
Cancellation. You can cancel anytime from Settings → Apple ID → Subscriptions on your device, or from inside Oriia via You → Settings → Manage Subscription. Cancellation takes effect at the end of the current billing period; you keep Premium access until then.
Refunds. Refunds are governed by Apple's refund policy. We do not directly process refunds. You may request a refund through Apple at reportaproblem.apple.com.
Free tier. A limited free version of the Service is available. Specific features (Weekly Synthesis, unlimited Align messages, additional Connections) require Oriia Premium.
4. Align credits (pay-per-question packs)
The Align AI guide is available without Premium but consumes credits. Credits can be purchased as one-time consumable packs (5, 15, or 40 credits) through Apple In-App Purchase. Credit purchases are final and non-refundable except where required by law. Credits do not expire while your account is active.
Oriia Premium subscribers receive a daily allowance of Align credits at no additional charge; the exact amount is disclosed in the App.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract source code from the App
- Attempt to bypass the App Check anti-abuse layer or rate limits
- Scrape, automate, or batch-request the Service
- Submit content that is harassing, defamatory, sexually explicit, or violates anyone's rights
- Submit data about another person (e.g., a Connection) without a legitimate basis to do so (see Section 12 of our Privacy Policy)
- Use the Service to harm yourself or others, or to bypass mental health, medical, legal, or financial professionals when one is needed
We may suspend or terminate your account for any violation of these rules.
6. AI and astrological content disclaimer
Oriia uses Google Gemini, a large language model, to generate daily rituals, the Align guide, weekly Synthesis, and Connections insights. This output is suggestive, not prescriptive. It does not constitute medical, psychological, financial, legal, or professional advice of any kind.
Specifically:
- Crisis or self-harm. If you are in crisis, contact a qualified professional or a crisis line (in Italy, Telefono Amico: 02 2327 2327). Oriia is not a crisis resource.
- Medical questions. Consult a doctor for any health concern. The Service cannot diagnose, treat, or replace medical care.
- Financial / legal decisions. Consult a licensed advisor. The Service does not predict outcomes of investments, lawsuits, contracts, or similar.
- Predictions and outcomes. The Service may discuss patterns and energetic windows but cannot predict specific outcomes, dates, or third-party behavior.
You acknowledge that astrology is a contemplative framework, not an empirical science. You use the output at your own discretion.
7. Intellectual property
The App, the Site, the rituals library, the snippet library, the brand, and all related content are the property of Fiorella Fonseca and protected by copyright and other intellectual property laws.
You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You may not reproduce, redistribute, or create derivative works of any Service content without prior written permission.
The third-party fonts (Exposure, Geist) and open-source libraries used by the Service are subject to their respective licenses.
8. Your content
You retain ownership of anything you submit to the Service (chat messages with Align, ritual feedback, Connections data you enter, etc.). By submitting it, you grant us a worldwide, royalty-free, non-exclusive license to use, store, and process that content for the sole purpose of operating and improving the Service.
We do not sell your content or use it for advertising. We do not use your Align messages to train third-party AI models beyond what is required to generate responses through Google's Gemini API at request time.
9. Privacy
Our handling of personal data is described in the Privacy Policy at oriia.app/privacy. By using the Service you also agree to the Privacy Policy.
10. Termination
You can stop using the Service at any time by deleting your account from inside the App (You → Settings → Delete Account). Account deletion erases your data from our systems within 30 days, subject to legal retention requirements.
We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. We will notify you of discontinuation with at least 30 days' notice where reasonably possible.
If your account is terminated, your active subscription (if any) is managed through Apple's settings; we do not separately refund prepaid periods.
11. Disclaimer of warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any output will meet your expectations.
You use the Service at your own risk.
12. Limitation of liability
To the maximum extent permitted by law, in no event will Fiorella Fonseca be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising out of your use of the Service.
To the extent any liability cannot be excluded under applicable law, our aggregate liability for any claim related to the Service is limited to the amount you paid for the Service in the twelve (12) months before the claim arose, or fifty euros (€50), whichever is greater.
Nothing in these Terms excludes liability that cannot be excluded under applicable Italian or EU consumer law.
13. Indemnity
You agree to indemnify and hold harmless Fiorella Fonseca from any claim, demand, or damages arising out of your breach of these Terms, your misuse of the Service, or your violation of any third party's rights (including a Connection's privacy rights as set out in our Privacy Policy).
14. Governing law and disputes
These Terms are governed by Italian law. Any dispute arising out of or in connection with the Service that cannot be resolved informally will be submitted to the exclusive jurisdiction of the courts of Milan, Italy, except where applicable consumer law gives you a right to sue in your country of residence.
If you are a consumer in the European Union, you may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
15. Apple-specific terms
These Terms are between you and Fiorella Fonseca only, not Apple. Apple is not responsible for the App or its content.
You acknowledge that:
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, regulatory compliance, or consumer protection claims.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. Changes to these Terms
We may update these Terms from time to time. When we make material changes:
- We update the Last updated date at the top.
- We notify you in-App and, where reasonable, by email if you have a linked account.
- For changes that materially expand your obligations or reduce our liability, we give you at least 30 days' notice before they take effect.
Continued use of the Service after the effective date of revised Terms constitutes acceptance. If you do not agree, you can delete your account at any time (Section 10).
